Repropol in defense of publishers

We would like to draw your attention to a special and extremely important case illustrating the state of the copyright market. It is about the tender of the Chancellery of the Sejm of the Republic of Poland for 24/7 media monitoring. For publications the use of which should cost the Chancellery of the Sejm, according to our estimates, in the range of PLN 135,000. zlotys per month, the ordering party wants to pay a maximum of PLN 8,000. zlotys.

The Association of Journalists and Publishers Repropol, as an organization for the collective management of publishers’ rights, is determined to intervene in this matter. We expect decisive action by the Tender Committee of the Investment and Technical Office of the Sejm of the Republic of Poland. In view of the selection of the most advantageous offer on August 12, 2022, we recommend repealing the offer selection process and calling the bidders to submit explanations pursuant to Art. 224 section 1 of the Public Procurement Law. We expect the offers to be rejected. We hope that the Sejm will exercise the rights of publishers of press publications in accordance with the copyright law.

In our application to the Chancellery of the Sejm, we emphasize that proprietary copyrights are absolute rights, and their violation constitutes a civil law tort entitling SDiW Repropol to directly pursue claims against any infringing entity.

We are aware that media monitoring companies contract with some publishers to use their publication databases. We hope that the intensive activity of our association will make these colleagues realize that concerted and solidary action will also bring them a measurable economic effect.

The Association of Journalists and Publishers Repropol was established and acts in the interest of press publishers and authors of press publications. In fact, we pursue an important part of the interest of Polish society, which is to strengthen dialogue, exchange of information and opinions, development of creativity and community social activities. Our task is to ensure compliance with the law adopted to protect this public interest, such as copyright law or the act on collective management of rights.

In the control mode, we also asked the Ombudsman for Patients’ Rights to review the ongoing cooperation with the pressclipper so that the publishers’ copyrights were duly respected. It’s hard to believe, but in the case of an order by the public treasury represented by the Office of the Patient Ombudsman, the publishers’ rights were valued at PLN 30 net. For this amount, 119 employees of the Bureau receive access to and use about 3,000 per month. press materials.

Both the secondary trading in publishers’ copyrights and the use of licenses for press publications and their fragments at prices different from those awarded by the KPA to Repropol, i.e. publishers, weaken press publishing houses economically, and thus limit the ability of society and the state to develop.

We will support institutions and clients of media monitoring companies in concluding contracts reflecting the state of the law. We hope that the copyright market will start to rebuild from the administrative and economic center of our country, from the Sejm.
