By the resolution of the Association of Journalists and Publishers REPROPOL of May 16, 2022, the Management Board of the Association of Journalists and Publishers, continuing the payment of remuneration for press titles, launched and made the payment of reprographic fees due to Press Publishers, referred to in Art. 20 and 201 of the Act on Copyright and Related Rights (of February 4, 1994, Journal of Laws No. 24 item 83) for titles published in 2021 according to the list of the National Library.

The division and amount of the fee is determined on the basis of the Association’s Principles and Regulations of Distribution, according to which fees will be paid to authorized publishers of titles that have exceeded the minimum payment threshold of PLN 100 gross. The amounts assigned to the titles that did not reach the threshold were added to the remuneration due to other entitled persons.

At the same time, we would like to inform you that when calculating the pool of reprographic fees to be divided for 2021, the provisions of the Act on collective management organizations for copyright and related rights and the new Code of Civil Procedure were taken into account, and thus some of the fees were reclassified as overdue fees, with the proviso that as regards fees for 2014 and previous years, the claim period for publishers expired, while in relation to unpaid fees for 2015, the claim remains valid and will be paid to publishers from current funds using the current cost index. Unpaid fees for the years 2016-2020 will be paid with the cost index appropriate for the given year.

The list of titles covered by the repartition and the fee amounts assigned to them can be found here. The list includes gross amounts for all titles covered by the reprographic fee for 2021.

At the same time, we would like to remind you that in accordance with the judgment of the Court of Justice of the EU (file reference number C-37/16) of January 18, 2017, and the subsequent judgment of the Supreme Administrative Court of June 26, 2017 (file reference number I FSK 178/13) , reprographic fees are not remuneration for services. VAT is not deducted from them. Therefore, REPROPOL is the issuer of all accounting documents on the basis of which reprographic fees are settled. We add the VAT due only to the costs related to the collection and distribution service.

In this situation, in order to settle and pay the reprographic fees due, you will receive two documents from the Association: a credit note for reprographic fees and a VAT invoice for the costs of the distribution collection.

In order for us to issue the above documents correctly, please complete and send to the Association the Publisher’s_fee 2021 Information Card below, in which we ask you to provide basic company details, indicate a contact person and agree to offset mutual settlements regarding the reprographic fee, confirmed by the accounting services of your publishing house . The card also contains a formula of consent to the exchange of financial documents by electronic means and the Publisher’s obligation to inform the Association of any change in address details and bank account numbers necessary to make the payment. Please also complete the table concerning the amount of circulation of press titles published by you. Input data is one of the indicators determining the amount of the fee, and the lack of such data authorizes the Association to estimate expenditures on its own.

The completed card and table should be immediately sent to the Association, preferably by electronic means in the form of a scan to the address repropol@repropol.pl.

The amount of the fee due to you will be transferred to the bank account provided by you after we receive the documents confirmed by you. Please do not issue or send any financial documents to the REPROPOL Association.

Authorized Publishers will be informed about the fee by separate correspondence, to which a template of the Information Card will also be attached.
